В апреле 2025 года Указ Президента РФ от 3 августа 2023 г. № 580 «О некоторых вопросах прохождения военной службы» претерпел существенные изменения.
Согласно изменениям увольнение с военной службы по состоянию здоровья в связи с признанием ограниченно годным к военной службе по подполковника включительно будет осуществляться в Вооруженных Силах РФ главнокомандующими (командующими) видами (родами войск) и командующими войсками войсками военных округов, в Росгвардии статс-секретарем — заместителем директора Росгвардии, командующими округами войск национальной гвардии РФ, а в ФСБ России — руководителем Службы организационно-кадровой работы.
Кроме того, граждане которые призывны по мобилизации в рамках Указа Президента РФ от 21 сентября 2022 г. № 647 дополнительно к 3 основаниям указанным в 647 Указе имеют право на увольнение с военной службы в случае, если они имеют на иждевении и воспитывают без матери несовершеннолетних детей (ребенка), а также могут быть уволены с военной службы по состоянию здоровья в связи с признанием ограниченно годным к военной службе.
Указанное изменение немного упрощает увольнение лиц, которые по состоянию здоровья не могут исполнять обязанности военной службы, и мобилизованных, которые имеют на иждевении детей.
Вместе с тем решение об увольнении с военной службы принимаются в исключительных случаях в соответствии с заключением аттестационной комиссии и с учетом необходимости эффективного выполнения задач.
Еще раз напоминаю, что критериев исключительности в настоящее время не существует, то есть тут у кого какой полет фантазии (т.е. нужно к имеющимся законным основаниям увольнения, добавить такие причины, чтоб члены аттестационной комиссии прослезились и вынесли решение, что да действительно его нужно уволить).
Изменения внесены Указом Президента РФ от 17.04.2025 № 248.
